90 DAYS LATE!?!?!? About 6 years ago I was involved in an a car accident and after several months of fighting with Allsnake Insurance I was forced to file personal bankruptcy. That act in and of itself was one of the most demeaning and demoralizing things I have ever had to go through. I have spent the last five years re-establishing my credit and building it up so that I could buy a new home. Three years ago when I bought my truck, my credit was squeaky clean...except for that stupid bankruptcy. I had zero late payments, zero adverse remarks, zero everything. So I got the truck loan without any problems. Fast forward to December of 2002 when I began to look for a new home. I was rejected for my first home loan because, as I was told by the lender, I had too many late payments with Bank of America. "What?!?", I asked him. "I don't have an account with B of A." So he faxed my credit report to me (on December 24th, no less) and there it was: Twenty-four late payments with Bank of America, each of them 90 days late. This was devastating enough to see on my own credit report, but what was really disturbing was that they began reporting me back in 2000, a full three years after that particular account was discharged in California Bankruptcy Court! Yes, I was denied my very first home loan simply because Bank of America made an error! My Christmas present from Bank of America was that I wasn't going to buy the home I was hoping to buy. I called B of A in January of 2003, and the first very very rude person I dealt with was a girl named Robin. I explained my situation to her and asked for a letter to give to my lender to explain the error. What did this little twit do? She snapped at me and told me that she was doing all of this out of "professional courtesy". You have GOT to be kidding!! I immediately told her to get her supervisor on the phone - do not pass go, do not collect $200 - proceed immediately to your supervisor! I spoke with Karen McCullough, who promised that the errors would be removed. I waited the obligatory 30 days for my next credit report and guess what? The credit reporting agencies contacted B of A regarding my dispute and B of A told them that the delinquencies were accurate. What this did was insure that I didn't get the first loan and they refused to include me as a potential homebuyer. In February of 2003, I contacted Karen McCullough yet again and I reminded her of who I was, and what she had promised to me. I reminded her that I was refused my home loan because of their errors. So we danced around this subject yet again, and within a couple of weeks I received a letter from Gail Oberlander. Gail stated that the delinquencies were in error and reported them to the major agencies, and I began looking for another home and another lender. I received a report from the credit reporting agencies showing that the delinquencies have been removed, and found another home and another lender. I have now placed $5,000 deposit on this new home and have signed the contracts. On May 27, 2003, my new lender ran my credit report and told me that my credit score has dropped. I'm thinking this was impossible, after all, I have had the negative activity removed and I have not only kept up all of my payments but I have paid off all of my debts altogether. I was thinking that the score should go up if it was going to change at all. So I looked over my credit report and there it was: Three 90-day-late payments to who else? BANK OF AMERICA! So here I am, two months away from the close of escrow and Bank of America has once again screwed up my credit report and as a result my lender has informed me that if my credit score does not go up I will be rejected (yet again) for my home loan. This is the last straw for me. New home pricing is out of my price range and there is no way I will qualify for a new home if this one doesn't go through. But I have the name and phone number of a credit attorney and it is my plan to sue Bank of America if this home loan does not go through. I've had it with companies like this, they do whatever they want to screw us over and don't give a damn about the consequences we have to face as a result of their errors. But if you make one late payment they are all over you like white on rice. The really disturbing thing about all of this is that they continue to screw me over on an account that no longer exists....and wasn't even theirs in the first place. This is EXACTLY the reason I don't bank with Skank of America and why I NEVER WILL! |
